Terms of Service

These Terms of Service ("Terms") govern your access to and use of the applications, web portals, software-as-a-service platforms, and engineering consulting services provided by Building IT LLC ("Building IT", "we", "us", or "our"), including iOS mobile applications distributed under Apple Developer Team ID YJ3A93662L (including SoloLiger, Sales Liger, SWAPP, and KnockYourSalesOff).

1. Acceptance of Terms

By downloading, installing, accessing, or using any software or service engineered by Building IT LLC, you affirm that you are at least 18 years of age, possess the legal authority to bind your organization, and agree to be bound by these Terms and our Privacy Policy.

2. Software Licensing & Permitted Use

Subject to your continuous compliance with these Terms and timely payment of applicable subscription or licensing fees:

• Building IT grants you a limited, non-exclusive, non-transferable, revocable license to install and execute our software solely for your internal business operations.
• You agree not to decompile, reverse-engineer, disassemble, modify, or create derivative works based upon our source code, binary distributions, or proprietary API protocols.
• You will not lease, sublicense, resell, or distribute our platform to any unauthorized third party without prior written consent from Building IT LLC.

3. Apple App Store Terms Compatibility

For any application downloaded through the Apple App Store:

• These Terms are concluded solely between you and Building IT LLC, and not with Apple Inc.
• Apple is not responsible for the application or its content, maintenance, or support.
• In the event of any failure of the application to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price as per App Store policies; to the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever.

4. Account Security & Responsibilities

You are solely responsible for maintaining the confidentiality of administrative credentials, API keys, and authentication tokens assigned to your account. You agree to notify Building IT immediately of any suspected breach or unauthorized system access.

5. Service Availability & SLA Commitments

While we engineer our cloud-native and edge infrastructure for 99.99% availability utilizing Cloudflare edge routing and high-availability database replication, services may occasionally experience scheduled maintenance windows or unforeseen upstream disruptions. Building IT LLC does not warrant that software operation will be completely uninterrupted or error-free.

6. Intellectual Property Rights

All software, algorithms, architecture diagrams, user interfaces, branding, trade secrets, and source code authored or developed by Building IT LLC remain the sole and exclusive intellectual property of Building IT LLC and its licensors. All rights not explicitly granted are reserved.

7. Limitation of Liability

To the maximum extent permitted under applicable law, Building IT LLC shall not be liable for any indirect, incidental, consequential, special, or punitive damages—including loss of profits, data, revenue, or business reputation—arising out of or relating to your use of our software or services, even if advised of the possibility of such damages. In no event shall Building IT LLC’s aggregate liability exceed the total amounts paid by you to Building IT LLC in the twelve (12) months preceding the incident.

8. Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without giving effect to any principles of conflicts of law. Any legal proceeding arising out of or related to these Terms shall be instituted exclusively in the federal or state courts located in California.
